1. Agreement
These Terms are an agreement between you and Bucky AI Inc. (“Bucky”, “we”, “us”), an Ontario corporation. They apply together with our Privacy Policy. If you buy an Enterprise or other written agreement, that agreement controls where it conflicts with these Terms.
2. Eligibility and accounts
You must be at least 18, or the age of majority where you live, and able to form a contract. If you use Bucky for an organization, you represent that you can bind it.
You are responsible for accurate registration details, for keeping credentials confidential, and for activity on your account. Tell us immediately at support@buckybuild.com if you suspect unauthorized use.
3. Plans and licences
Bucky offers Personal, Professional, and Enterprise plans, and may offer trials or pilots. Current features and prices are on the pricing page and at checkout.
Personal plans are licensed for an individual. Professional and Enterprise plans are licensed for commercial and team use as described when you subscribe. These Terms do not restrict Professional or Enterprise customers to personal, non-commercial use.
We grant you a limited, non-exclusive, non-transferable licence to use the service for the term of your plan. We and our licensors keep all other rights in the software, data products, models, and branding.
4. Fees, trials, and cancellation
Paid plans are billed in advance for the period you choose. Taxes may apply. Web subscriptions are billed by Stripe and managed from account settings. App Store subscriptions are billed by Apple; we cannot cancel an Apple subscription for you — use Settings → your name → Subscriptions on the device.
Subscriptions renew until you cancel. Cancellation stops the next renewal; you keep access until the end of the period already paid. Unless a specific offer says otherwise, fees are non-refundable except where required by law or by Apple’s or Stripe’s rules.
We may offer a trial. The length, whether a card is required, and what happens when the trial ends are stated when you start it. If you do not subscribe, paid features stop when the trial ends.
5. Acceptable use
You agree not to:
- Use Bucky for any unlawful purpose, or to infringe others’ rights.
- Copy, scrape, reverse engineer, or resell the service, our data products, or generated reports except as your plan expressly allows.
- Present Bucky outputs as a survey, legal opinion, architectural stamp, or municipal approval.
- Share a single login in place of the seats your plan requires, or interfere with other customers’ use.
- Upload malware, or content you do not have the right to use.
- Probe or overload our systems, or those of municipalities and data providers we query.
We may suspend or terminate accounts that breach these rules.
6. Your content
You keep ownership of content you upload or create in Bucky. You grant us a non-exclusive licence to host, process, display, and create derivatives of that content solely to operate and improve the service for you (including generating reports and Assist replies).
That licence is not a right to train third-party foundation models on your project content. You represent that you have the rights to the content you submit, including personal information about other people.
7. Bucky intellectual property
The service, software, documentation, look and feel, and Bucky-created data products are owned by Bucky AI Inc. or our licensors. Catalogue designs remain the property of their authors and issuing organizations, as described below.
8. No professional advice; AI and site intelligence
Bucky provides information and tools to support housing and development planning. We are not your architect, engineer, planner, lawyer, surveyor, or financial advisor. Zoning, parcel, ownership, and feasibility results can be incomplete, out of date, or wrong. Always verify against primary sources and qualified professionals before you spend money, file an application, or start construction.
AI features can hallucinate, omit citations, or miss local rules. You are responsible for checking outputs before you rely on them. Additional advisory services, if we offer them, will have their own terms.
9. Catalogue designs and attribution
Bucky displays publicly available housing designs from federal, provincial, and municipal catalogues across Canada, including the CMHC Housing Design Catalogue. Bucky is not affiliated with, endorsed by, or partnered with any catalogue publisher, government body, or architecture firm unless we say so explicitly.
Design attribution is provided where it is publicly available. All catalogue designs remain the intellectual property of their creators and issuing organizations. Bucky does not build, design, or modify these designs.
A qualified professional must adapt any catalogue design to your site, codes, and bylaws. For more detail, see our Catalogue Disclaimer.
10. Third-party services
The service may link to or embed third parties (maps, payments, booking, builders, lenders, government programs). Their terms and privacy practices apply to their products. We are not responsible for them.
11. Suspension and termination
You may stop using Bucky and delete your account from Settings. We may suspend or terminate access if you breach these Terms, if we must do so by law, or if we discontinue the service. We will give notice when it is reasonable to do so. Sections that should survive (including intellectual property, disclaimers, liability limits, and indemnity) survive termination.
12. Disclaimers and limitation of liability
To the maximum extent permitted by law:
- The service is provided “as is” and “as available”, without warranties of any kind, including accuracy of zoning, ownership, or AI output.
- Bucky AI Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the platform.
- Our total liability for claims relating to the service is limited to the fees you paid us for the service in the twelve months before the claim, or CAD $100 if you have not paid fees.
13. Indemnity
You will defend and indemnify Bucky AI Inc. and its directors, officers, and employees against claims, damages, and costs (including reasonable legal fees) arising from your content, your use of the service, or your breach of these Terms, except to the extent caused by our wilful misconduct.
14. Changes
We may update these Terms by posting a new version on this page and updating the date above. Material changes may also be announced by email or in the product. Continued use after the effective date constitutes acceptance, except where the law requires a new agreement.
15. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. The courts of Toronto, Ontario have exclusive jurisdiction, except that we may seek injunctive relief in any competent court, and except where applicable consumer law gives you a right to sue where you live.
